IPOD TOUCH 4G TROUBLE !?

so i bought the new ipod touch 4g when it came out in october and here it is early june . it has been eight months. yes i know that apple will not replace your ipod touch if it has water damage, even though it has had contact with it , but it still works and that was early december. anyways, my volume and power buttons will not work what so ever, i have tried holding the buttons, yanking the usb out of it, taking the cover off,restarting it, updating it ,and all of the other simple stuff . will apple give me another ipod touch BRAND NEW and if they won't will they make me give them a fee , how much if so ? plus i got it from best buy eight months ago . i live in florida, if that is needed .
